Mother demands responsibility after dog bites her son in Denver park

DENVER (KDVR) — A Denver mother is speaking out after she said a dog bit her son at a neighborhood park and the dog’s owner simply walked away.

Alex said her 8-year-old son was playing with his older brother and a few friends at Mayfair Park in Denver on Sunday.

“He walked up to a lady who had her dog on a leash and asked if he could pet the dog and the lady said yes,” Alex said. “He bent down to pet the dog and the dog bit him on his upper right arm.”

Alex said the owner asked her son if he was OK and then left.

“It’s really upsetting that she just left knowing the dog bit my son,” Alex said. “Thank God it wasn’t a terrible bite, which means no stitches and no lifelong disfigurement, but it is a fact that people should take personal responsibility, especially if you have a dog.”

Alex said she was not present to witness the dog bite but spoke to several witnesses. The ordeal led to her visiting the emergency room along with the rabies shot.

“I don’t know how much the insurance will cover the vaccinations, but I know the urgent care visits all count toward the deductible, so we’ll probably owe a few thousand for sure,” Alex said.

Are dog owners liable for bites in Colorado?

Attorney Matthew Hamblin of Robinson & Henry PC said under Colorado’s dog bite law, a dog owner is liable for economic damages if their dog causes serious bodily injury.

“Because the injuries in this case are not serious physical injuries, the child’s mother would have to prove that the dog’s owner knew or should have known prior to the attack that the dog was dangerous,” Hamblin said.

But for Alex, it’s all about responsibility.

“Here, too, I take on a certain amount of responsibility. “It’s my child and I wasn’t there,” Alex said. “You can’t always protect them 100%, but you do your best. So that was a big learning experience and there’s no way I’m going to let that happen again.”

Alex said she’s not giving up and hopes the owner will reach out so he can get some answers.
